Terms of Use for SKS Creative Template Marketplace

1. General

The SKS Creative Template Marketplace offers templates exclusively for use on the Wix platform. These templates, along with related add-on services, are designed to enhance the functionality and appearance of your digital projects.

2. Template Licensing

Upon purchase, SKS Creative grants you a single-use, non-exclusive license subject to the following conditions:
 

  • Single Use: The template may be used for one final product, by you or one client. The final product may be distributed for free.

  • Non-transferable and Non-sublicensable: The license is for your use or use by one client. It cannot be transferred or sublicensed to any other party.

  • No Redistribution: You may not sell, redistribute, or give away the template in its original, modified, or derivative form.

  • Prohibitions: Modifying the template to create a competing product or repurposing it in any manner that violates these terms is strictly prohibited.
     

Delivery of Templates
 

  • Standard Delivery: Templates will be sent to the customer within 24-48 hours of purchase.

  • Template Setup Add-On Delivery: When Template setup is added, the turnaround time is 3-5 business days, depending on the timely receipt of all necessary content from the customer, including text, copy, logo, and images.
     

3. Types of Templates
 

  • Classic Editor Templates: Ideal for users at all skill levels, these templates are designed to be user-friendly and accessible through the standard Wix Editor.

  • Wix Studio Templates: Crafted on an advanced design platform, the Wix Studio Editor, these templates are tailored for users with a sophisticated understanding of web design and development. Utilizing these templates effectively requires a higher level of technical proficiency and design expertise.
     

4. Template Setup

Template setup is an additional service available for purchase with any template. This service includes:
 

  • Included Modifications: Adding your logos, making color changes (up to five colors), setting up three types of fonts (heading, sub-heading, paragraph), adding text, and inserting images to pages.

  • Social Media and Page Adjustments: Linking to your social media accounts and removing unnecessary pages as specified.

  • Exclusions: Setup service does not include adding new pages, sections, or integration of features like online stores, blogs, courses, or advanced functionalities not included in the original template.

  • Support Limitations: Templates purchased without the setup service are provided as-is. SKS Creative does not offer support for modifications on these templates. Customers are responsible for making their own changes.
     

5. Maintenance Plans

SKS Creative offers annual maintenance plans that provide ongoing updates and technical support to ensure your template remains functional and up-to-date. Detailed information about what these plans cover is available on our website.

6. Hosting and Domain Requirements

All templates require a Wix premium hosting plan and a domain name, which must be obtained from Wix directly. SKS Creative does not provide hosting or domain registration services.

7. Intellectual Property Rights

All templates and related content provided by SKS Creative are the intellectual property of SKS Creative or its licensors. Unauthorized use, duplication, or modification is expressly prohibited, except as allowed under these terms.

8. No Refunds

All sales of templates and services are final and non-refundable. Customers are encouraged to review the template details thoroughly before making a purchase to ensure it meets their needs.

9. Limitation of Liability

SKS Creative shall not be liable for any indirect, special, incidental, consequential, or punitive damages arising out of or related to the use of the Marketplace or any content or services provided therein.

10. Indemnification

You agree to indemnify, defend, and hold harmless SKS Creative and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms, or your violation of any law or the rights of a third party.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in California for any legal proceedings related to these Terms.

12. Amendments to Terms

SKS Creative reserves the right to modify or replace these Terms at any time. Customers will be notified of any significant changes via direct communication or through updates posted on the marketplace.
